Elder abuse and neglect makes a victim of vulnerable elderly residents who often rely on the caretakers to tend to their daily needs, including feeding, hygiene, and even shifting in bed. When neglected and left to care for themselves, these elderly residents are virtually helpless, and that isolation can often be overwhelming. Elder abuse and neglect takes on many forms, including physical, mental, and financial injuries. Further, these injuries can be the result of recurrent conduct or one single injury-producing event. Being that our firm specializes in this particular type of law, our attorneys have dealt with the many forms elderly abuse can manifest and occur. Common examples include malnutrition or dehydration, providing inadequate supervision to residents, committing medication errors, permitting the occurrence of physical abuse, and maintaining untrained or insufficient nursing staff. If any of these abusive scenarios have happened to you or a loved one in a nursing home, our attorneys can offer legal guidance and take your claim to court to seek compensation for your injuries, pain and suffering.
Elder Abuse and Dependent Adult Civil Protection Act
In 1991, the California State Legislature passed the Elder Abuse and Dependent Adult Civil Protection Act in an attempt to address the rising egregious elder abuse and neglect problem that California and the rest of this country faces. In addition to making nursing home abuse and neglect a statutory violation, this legislation also allows victims to recover past and future medical expenses, attorney’s fees, and pain and suffering damages. Further, under the Act, enhanced or punitive damages are also made available to people who have been injured as a result of nursing home abuse or neglect. Our elder abuse attorneys have an in-depth knowledge of this Elder Abuse Act, and have successfully litigated numerous cases of its violation.
The Act provides victims of elder abuse and neglect with many avenues for recovery.
