In 1991, the California State Legislature passed the Elder Abuse and Dependent Adult Civil Protection Act in an attempt to address the rising egregious elder abuse and neglect problem that California and the rest of this country faces. In addition to making nursing home abuse and neglect a statutory violation, this legislation also allows victims to recover past and future medical expenses, attorney’s fees, and pain and suffering damages. Further, under the Act, enhanced or punitive damages are also made available to people who have been injured as a result of nursing home abuse or neglect.
